In the event of a confirmed site outage, the item on the block at the time of issue will qualify for Tophatter Site Outage Seller Protection as defined, if the following conditions are met:
  1. The item was on the block during the site outage. The definition of "during the site outage" is +/- 2 minutes of site or auctioneer-downtime on the Site Status page.
  2. The Seller honored the sale for the winning bid and shipped the winning buyer's order, or the item was Unsold.

Tophatter Site Outage Seller Protection is defined as:
  1. Reimbursement of all seller fees to the Seller in the form of Tophatter seller credit.
  2. If the affected item sold and the seller honored the sale, and the item is a new, high-end item with a confirmed retail price over $100 which includes designer fashion and electronics, protection includes reimbursement to the Seller of up to the wholesale cost if winning bid did not meet or exceed that amount. Requests must be made by the Seller and valid receipt or proof of purchase indicating wholesale price paid is required. This will be reimbursed in the form of Tophatter seller credit.

Note Regarding Partner Events: Under Site Outage Seller Protection only specifically affected lots as defined above and confirmed through the Site Status page may qualify for reimbursement if the described conditions are met.
